SERVICES PROVIDED

Youtube Service allows users to discover, watch and share videos and other content, provides a forum for people to connect, It serves as a distribution platform for original content creators and marketers of all sizes throughout the world, as well as informing and inspiring others around the world.

ELIGIBILITY OF USER

• The user must be at least 13 years old to use the Services. However, if authorised by a parent or legal guardian, children of all ages can access YouTube Kids (where available).
• If enabled by a parent or legal guardian, children of all ages can use YouTube Kids (where available).

RESTRICTIONS ON SERVICES

The following restrictions apply to user use of the Service.

Users are not allowed to:

• Access, reproduce, download, distribute, transmit, broadcast, display, sell, license, alter, modify or use any part of the Service otherwise,
• Circumvent, disable, fraudulently engage with, or otherwise interfere with any part of the Service (or attempt to do any of these things),
• Access the Service using any automated means (such as robots, or scrapers)
• Collect or harvest any information that might identify a person (for example, usernames), unless permitted by that person,
• Provide unsolicited promotional or commercial content, as well as other unwelcome or mass solicitations, over the Service,
• Cause or encourage any erroneous assessments of real user involvement with the Service,
• Misuse any reporting, flagging, complaint, dispute, or appeals process, including by making frivolous or vexatious contributions,
• Use the Service to view or listen to Content other than for personal, non-commercial use (for example, the user may not publicly screen videos or stream music from the Service)

USER CONTENT

If the user has a YouTube channel, the user may be able to upload Content to the Service.

User may use their Content to promote business or artistic enterprise.

If the user chooses to upload Content, they must not submit to the Service any Content that does not comply with this Agreement or the law. For example, third-party intellectual property (such as copyrighted information) must not be included in the Content user contribute unless the user obtains permission from that party or are otherwise legally permitted to do so.

Users are legally responsible for the Content user submit to the Service. Youtube may use automated systems that analyze user Content to help detect infringement and abuse, including spam and malware.

ACCOUNT SUSPENSION & TERMINATION

Effect of Account Suspension or Termination

Users may continue to use certain parts of the Service (such as viewing only) without a Google account if their Google account is cancelled or their Google account’s access to the Service is restricted, and this Agreement will apply to such usage.

Terminations by user
Users may stop using the Service at any time which involves closing their YouTube channel and removing data. Users can also download a copy of their information first.

Terminations and Suspensions by YouTube for Cause

YouTube may suspend or terminate users use of the Services, Google account, or Google account’s access to all or part of the Service if

(a) user materially or repeatedly breach this Agreement; 

(b) are required to do so to comply with a legal requirement or a court order; or

(c) believe there has been conduct that creates (or could create) liability or harm to any user, another third party, YouTube or Affiliates.

Terminations by YouTube for Service Changes

YouTube may terminate use of the Services, or Google account’s access to all or part of the Service if YouTube believes, in its sole discretion, that provision of the Service to the user is no longer commercially viable. 

Notice for Termination or Suspension

Youtube will notify the user of the reason for termination or suspension by YouTube unless they reasonably believe that to do so:

(a) would break the law or a legal enforcement authority’s order, or expose YouTube or our Affiliates to legal liability;

(b) would jeopardise an investigation or the integrity or operation of the Service; or

(c) would hurt any user, another third party, YouTube, or our Affiliates.

Where YouTube is terminating use for Service changes, where reasonably possible, the user will be provided with sufficient time to export their Content from the Service.

GOVERNING LAW

Regardless of conflict of laws regulations, any issues arising out of or pertaining to these terms or the Service will be governed by California law.

These disputes will be decided solely in the federal or state courts of Santa Clara County, California, USA, and both the user and YouTube agree to submit to the personal jurisdiction of those courts.
