Terms of Advertising
The advertiser(s) are not subject to:
- Engage in advertising to or solicitation of, other Platform Users to buy or sell any products or services, including, but not limited to, products or services connected to those advertised on the Platform or Myntra,
- Shall not pretend that they are, or that they represent, someone else, or impersonate any other individual or entity,
- The advertisers shall at all times ensure full compliance with the applicable provisions of the Information Technology Act, 2000 and rules thereunder, as applicable and as amended from time to time, as well as all applicable domestic laws, rules, and regulations (including provisions of any applicable Exchange Control Laws or Regulations in Force) and international laws, foreign exchange laws, and other international laws, rules, and regulations, Statutes, Ordinances and Regulations (including, but not limited to Sales Tax/VAT, Income Tax, Octroi, Service Tax, Central Excise, Custom Duty, Local Levies) regarding the use of service and their listing, purchase, solicitation of offers to purchase, and sale of products or services.
- Advertiser(s) shall not engage in any transaction in an item or service, which is banned by the terms of any applicable legislation, including current exchange control laws and regulations
- The views expressed in the content are not necessarily those of Myntra. In no event will Myntra be held liable for any Content posted, or for any claims, damages, or losses arising from the use of Content and/or appearance of Content on the Platform.
- Advertiser(s) represent and warrant that they have all required rights in and to the Content and information they provide and that such Content does not infringe on any third-party proprietary or other rights, or contain any libellous, tortious, or otherwise unlawful material.
Content
All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music and artwork are third-party user-generated content and Because Myntra is just a middleman for the purposes of these Terms of Use, it has no control over such third-party user-generated content.
Advertisers shall be entitled to, consistent with Myntra’s Privacy Policy as adopted in accordance with applicable law, use the Content or any of its elements for any purpose, including but not limited to promotional and advertising purposes, in any media now known or subsequently developed, including the creation of derivative works that may include the Content advertisers provide, in perpetuity.
Disclaimer of Liability
All the Products advertised on Myntra’s platform are governed by different state laws and if the advertiser is unable to advertise such Products due to implications of different state laws, the advertiser will have to remove the ad from such platform.
By providing Myntra with the advertiser’s phone number, the advertiser agrees to be contacted by Myntra via phone calls and/or SMS notifications in the event of any order, shipping, or delivery-related updates.
Myntra will not contact the user with promotional phone calls or SMS based on their personal information.
Indemnity
Advertisers shall indemnify and hold harmless Myntra, its owner, licensee, affiliates, subsidiaries, group companies (as applicable) and their respective officers, directors, agents, and employees, from any claim or demand, or actions including reasonable attorneys’ fees, made by any third party or penalty imposed due to or arising out of advertiser(s) breach of this Terms of Use, Privacy Policy and other Policies, or violation of any law, rules or regulations or the rights (including infringement of intellectual property rights) of a third party.
Trademark & Copyrights
The platform is controlled and operated by Myntra and products are advertised by respective Advertisers.
Copyrights, trademarks, and other intellectual property rights protect all of the information on the Platform, including photographs, graphics, audio clips, and video clips. Material on Myntra is solely for personal, non-commercial use. Advertisers must not copy, reproduce, republish, upload, post, transmit or distribute such material in any way, including by email or other electronic means and whether directly or indirectly and advertisers must not assist any other person to do so.
Without the prior written consent of the owner, modification of the materials, use of the materials on any other Myntra or networked computer environment or use of the materials for any purpose other than personal, non-commercial use is a violation of the copyrights, trademarks and other proprietary rights, and is prohibited.
Advertisers retain ownership of and are solely responsible for any content that they submit or upload while using any Service, including any text, data, information, pictures, photographs, music, sound, video, or other material that they may upload, send, or store when using Our different services.
Myntra reserves the right to use/reproduce any content uploaded by advertisers and advertisers shall agree to grant royalty free, irrevocably, unconditionally, perpetually and worldwide right to Myntra to use the content for reasonable business purposes.
Governing Law
The terms shall be governed and construed in accordance with Indian law, without regard to conflict of laws principles, and any disputes arising out of or in connection with them shall be subject to the exclusive jurisdiction of the courts, tribunals, fora, and competent authorities in Bangalore.
Bangalore will be the sole and exclusive place of jurisdiction.
