ELIGIBILITY OF USERS
Instagram wants their Services to be as open and inclusive as possible, but also want it to be safe, secure, and in accordance with the law. So, they need users to commit to a few restrictions in order to be part of the Instagram community.
- The user must be at least 13 years old or the minimum legal age in the user’s country to use Instagram.
- User must not be prohibited from receiving any aspect of Service under applicable laws or If a user is on a list of denied parties, he can’t engage in payment-related services.
- Instagram must not have previously disabled users account for violation of law or any of their policies.
- The user must not be a convicted sex offender.
RESTRICTIONS ON USERS

User can’t impersonate others or provide inaccurate information: User doesn’t have to disclose their identity on Instagram but must provide accurate and up to date information (including registration information). Also, the user may not impersonate someone they aren’t, and the user can’t create an account for someone else unless they have their express permission.
- The user may not engage in any illegal, deceptive, or fraudulent activity, or use the service for any illegal or unauthorised purpose.
- User can’t violate (or help or encourage others to violate) these Terms or our policies.
- User can’t do anything to interfere with or impair the intended operation of the Service.
- A user cannot establish accounts, access, or collect information in an unauthorised manner: This includes the creation of accounts or the automated collection of information without express authorization.
- Users can’t attempt to buy, sell, or transfer any aspect of your account (including your username) or to seek, collect, or utilise other users’ login credentials or badges.
- The user is not permitted to post private or confidential material or to engage in conduct that infringes on the rights of others, including intellectual property rights.
PERMISSIONS
- “We do not claim ownership of your content, but you grant us a license to use it”: Nothing is changing about users rights in their content. Instagram does not claim ownership of users’ content that they post on or through the Service. Instead, when user share, post, or upload content that is covered by intellectual property rights (like photos or videos) on or in connection with the Service, the user hereby grant to them a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to host, use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of content (consistent with privacy and application settings). Users can end this license anytime by deleting their content or account. However, the content will continue to appear if the user shared it with others and they have not deleted it.
- Permission to use user’s username, profile picture, and information about user’s relationships and actions with accounts, ads, and sponsored content: User gives Instagram permission to show username, profile picture, and information about users actions (such as likes) or relationships (such as follows) next to or in connection with accounts, ads, offers, and other sponsored content that user follows or engage with that are displayed on Facebook Products, without any compensation to the user. For example, Instagram may show that users liked a sponsored post created by a brand that has paid them to display its ads on Instagram. Actions on sponsored material and follows of sponsored accounts, like actions on other content and follows of other accounts, can only be seen by users who have the authorization to see that content or follow that account. Instagram will also respect your ad settings.
- User agree that Instagram can download and install updates to the Service on a user’s device.
CONTENT REMOVAL AND TERMINATION OF ACCOUNT
- Instagram can remove any content or information user shares on the Service if they believe that it violates these Terms of Use, or Instagram is permitted or required to do so by law.
- Instagram can refuse to provide or stop providing all or part of the Service to the user (including terminating or disabling account) immediately to protect our community or services, or if a user creates risk or legal exposure for them, violate these Terms of Use or their policies, if the user repeatedly infringes other people’s intellectual property rights, or where they are permitted or required to do so by law.
- If Instagram takes action to disable or terminate an account, they will notify the user where appropriate. If the user believes their account has been terminated in error, or the user wants to disable or permanently delete their account, they can consult Instagram Helpline.
- Content User deletes may persist for a limited period of time in backup copies and will still be visible where others have shared it.
DISPUTE RESOLUTION
The laws of the country in which the User resides will apply to any claim, a cause of action or a disagreement user have with Instagram arising from or relating to these Terms (“claim”), and the User has the option of resolving their claim in any competent court in that nation that has jurisdiction.
In all other cases, the user agrees that the claim must be resolved exclusively in the United States District Court for the Northern District of California or a state court in San Mateo County, that user consent to the personal jurisdiction of either of these courts for the purposes of litigating any such claim, and that the laws of the State of California will govern these Terms and any claim, without regard to conflict of law principles.
