SERVICES OFFERED:

• Myntra provides a number of Internet-based services through the Platform. One such service allows users to purchase original items from numerous fashion and lifestyle brands, such as apparel, footwear, and accessories.
• The Products can be purchased on the Platform using a variety of payment methods. Specific sale policies, such as cancellation policies, exchange policies, return policies, and so on, will apply to the sale/purchase of Products.
• It has been clarified that when creating a return request, users must affirm (through a check box click) that the product being returned is unused and has all of the original tags attached.
• If the user returns a product that is used, damaged, or lacking the original tags, the user’s return request will be denied, and the goods will be re-shipped to the customer. If the return request is denied, the user will not be eligible for a refund, and Myntra will not be held liable in this case. Furthermore, if the user refuses to accept delivery of the re-shipped product, the user will no longer be eligible for a refund, and Myntra will bear no responsibility for the return or refund of the re-shipped product.
• In addition, these Terms of Use may be further supplemented by Product specific conditions, which may be displayed with that Product.
• Myntra makes no representations or warranties about the accuracy, completeness, reliability, currentness, or error-free nature of Product descriptions or other material on the Platform, and assumes no duty in this regard.

USER CONDUCT AND RULES ON THE PLATFORM:

User agrees, undertakes, and confirms that the following binding principles will govern User’s usage of the Platform:

• User agrees not to host, display, upload, change, publish, transmit, update, or share any data that:
  • belongs to another person and to which User does not have any right to,
  • is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invasive of another’s privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever,
  • is misleading in any way,
  • It entails the distribution of “junk mail,” “chain letters,” or unsolicited bulk mailing, often known as “spamming”,
  • supports illegal activity or behaviour that is abusive, threatening, vulgar, defamatory, or libellous,
  • infringes or violates the rights of any third party, including, but not limited to, intellectual property rights, privacy rights (including, but not limited to, unlawful disclosure of a person’s name, email address, physical address, or phone number), or publicity rights,
  • It contains restricted or password-protected pages, as well as hidden or password-protected pages or images (those not linked to or from another accessible page),
  •  offers training on criminal actions such as constructing or purchasing illegal weapons, compromising someone’s privacy, or providing or creating computer viruses,
  • includes video, pictures, or images of someone else (with a minor or an adult),
  • Attempts to obtain unauthorised access to the Platform or profiles, blogs, communities, account information, bulletins, friend requests, or other parts of the Platform, or solicits passwords or personal identifying information from other users for commercial or unlawful purposes,
  • interferes with another User’s use and enjoyment of the Platform or any other individual’s User and enjoyment of similar services,
  • shall not be fraudulent or involve the sale of counterfeit or stolen products, or infringes any patent, trademark, copyright, or other intellectual rights, or third party trade secrets, rights of publicity, or privacy, or shall not be fraudulent or include the sale of counterfeit or stolen products,
  • infringes on any currently enacted law,
  • Endangers India’s unity, integrity, defence, security, or sovereignty, cordial relations with other nations, or public order; or causes incitement to commit any cognizable offence; or insults any other nation,
  • shall not be deceptive, deceptive, or deceptive,

If any of the following scenarios are satisfied, a User may be considered fraudulent, or a business may suffer a loss as a result of fraudulent activity:

• Users don’t reply to the payment verification mail sent by Myntra,
• Users fail to produce adequate documents during the payment details verification,
• Misuse of another Users’ phone/email,
• Users use invalid addresses, email and phone number,
• Excessive use of a voucher code,
• Use of a special voucher that isn’t associated with the email address used,
• Users return the wrong product,
• Users refuse to pay for an order,
• Users involved in the snatch and run of any order,
• Miscellaneous operations were carried out with the sole goal of causing Myntra to lose business or money,
• User with a very high return rate,
• Repeated request for monetary compensation for fake/used order.

CONTENTS POSTED ON PLATFORM:

All text, graphics, user interfaces, visual interfaces, pictures, trademarks, logos, sounds, music, and artwork are third-party user-generated content, and Because Myntra is just a middleman for the purposes of the Terms of Use, it has no control over such third-party user-generated content.

Such Content becomes Myntra’s property and the User grants the worldwide, perpetual and transferable rights in such Content.

Myntra shall be entitled to use the Content or any of its elements for any type of use forever, including but not limited to promotional and advertising purposes, in any media now known or hereafter devised, including the creation of derivative works that may include the Content User provide, in accordance with the Privacy Policy as adopted in accordance with applicable law.

Users may download information on items and services that have been purposefully made available on the Platform, provided that User:

• Do not remove any proprietary notice language in all copies of such documents,
• Use such information only for User personal, non-commercial informational purposes and do not copy or post such information on any networked computer or broadcast it in any media,
• Make no modifications to any such information, and
• Do not make any additional representations or warranties relating to such documents.

TERMINATION:

Myntra may suspend or terminate User use of the Myntra or any Service if it believes, in its sole and absolute discretion that User has infringed, breached, violated, abused, or unethically manipulated or exploited any term of these Terms of Service or anyway otherwise acted unethically.

Notwithstanding anything in this clause, these Terms of Service will survive indefinitely unless and until Myntra chooses to terminate them:

• If User or Myntra terminates User’s use of the Platform or any Service, Myntra may delete any content or other materials relating to Users use of the Service and Myntra will have no liability to User or any third party for doing so. However, the User’s transactions details may be preserved by Myntra for purposes of tax or regulatory compliance.
• Myntra may unilaterally terminate the User’s account on any event as mentioned in the Terms Of Use. In this instance, all loyalty or referral programme credits, Myntra credit, and any pending refunds would be forfeited. Myntra has the right to refuse returns or refunds to such users.
• If the User uses any false e-mail address or uses the portal for any unlawful and fraudulent purposes, which may cause annoyance and inconvenience and abuses any policy and rules of the company or mislead Myntra by sharing multiple addresses and phone numbers or transacting with mala-fide intentions then Myntra reserves the right to refuse access to the portal, terminate accounts including any linked accounts without notice to User.
