RIGHTS OF THE USER
Anything any individual posts on their profile on Facebook is completely and exclusively owned by the individual, i.e. the right to ownership of said content is with the owner as an intellectual property right (copyright, trademark). But when the user agrees with the terms and conditions of Facebook, Facebook acquires a ‘licence’, to copy, store, distribute, and even share such content.
Every account holder has the right to delete his/ her account, whenever they want to. But when it comes to deleting content, the user can delete any content from his / her account but that does not imply that the content is also deleted from the servers of Facebook. After deleting any content from their account it takes 90 days for the Facebook servers to completely delete the content.
RESTRICTIONS ON USER
- User may not upload viruses or malicious code, or do anything that could disable, overburden or impair the proper working or appearance of the Products of Facebook.
- User may not access or collect data from the Products of Facebook using automated means (without facebook’s prior permission) or attempt to access data that the user do not have permission to access.
- User may not use Facebook’s Products to do or share anything :
- If that breaches the Terms, and other Terms and Policies that apply to user’s use of Facebook.
- That is unlawful, misleading, discriminatory or fraudulent.
- That infringes or violates someone else’s rights, including their intellectual property rights.
UPDATING TERMS
Facebook will only make changes if the provisions are no longer appropriate or if they are incomplete, and only if the changes are reasonable and take due account of user’s interests.
Facebook will notify the user (for example, by email or through our Products) at least 30 days before they make changes to these Terms and give them an opportunity to review them before they go into effect unless changes are required by law. Once any updated Terms are in effect, the user will be bound by them if they continue to use the Products.
DELETION OF CONTENTION
When a user deletes content, it’s no longer visible to other users. However, it may continue to exist elsewhere on other systems where:
- Immediate deletion is not possible due to technical limitations (in which case, the content will be deleted within a maximum of 90 days from when a user deletes it);
- Content has been used by others in accordance with this licence and they have not deleted it (in which case, this licence will continue to apply until that content is deleted); or
Where immediate deletion would restrict the ability to:
- Investigate or identify illegal activity or breaches of Facebook’s Terms and Policies (for example, to identify or investigate misuse of Products or systems);
- Comply with a legal obligation, such as the preservation of evidence; or
- Comply with a request of judicial or administrative authority, law enforcement or a government agency
ACCOUNT SUSPENSION OR TERMINATION
- If Facebook determines that any user has clearly, seriously or repeatedly breached the Terms or Policies of Facebook, including in particular the Community Standards, Facebook may suspend or permanently disable access of such user to their account.
- Facebook may also suspend or disable user’s account if they repeatedly infringe other people’s intellectual property rights or where they are required to do so for legal reasons.
Where Facebook takes such action, they’ll let the user know and explain any options user have to request a review, unless doing so may expose Facebook or others to legal liability, harm Facebook community of users, compromise or interfere with the integrity or operation of any of the services, systems or Products; or where Facebook is restricted due to technical limitations, or where Facebook is prohibited from doing so for legal reasons.
